The APUCSM informs about the situation regarding the Canals in Sta. Margarita
On the 12.8.09 the “Asociacion de Propietarios de la Urbanizacion Canales Santa Margarita” conducted an information meeting for owners of property along the canals. Ahead of said meeting the same information was given to Spanish and French owners.
At first the representatives introduced themthelves and the organisation. They pointed out that the APUCSM was founded through a private initiative and works on a honorary base to defend the common interest of all owners of homes and berth situated directly along the canals.
The APUCSM is a subgroup of the “Asociacion de Vecinos … Sta. Margarita” and is open for all here present language groups. The proven and legal rights of the owners can only be protected in the long run by a strong asociacion , with a large number of members and the necessary financial means.
The Spanish state and the regional government of Catalonia and the city of Rosas are trying to transgress our rights and gain control of the valuable property of the owners. It was declared that different governmental bodies referring to different laws require separate objections to be filed.

An important point was to give information and to answer questions to the latest letter from the coastal authorities in Girona representing the invironmental ministry in Madrid. The owners that at this time have objected against the act of the Spanish state are getting this letter. If you were represented through a lawyer he will get this letter. The letter informs that the act of the demarcation is now in the state of “Tramite de Audiencia” which means that the affected owners will be heard. They can file an additional objection. These objections, as before, have to be filed by the individual owners or Communities. The APUCSM urgently recommends you to do that.
A form was developed and can be downloaded from the above given website ( look “Expansion la oposition”). In addition to the elaborate objection form exists an addendum (“Anexos”) with important and up to date unknown documents, who strengthen the position of the owners.
If the objection is not made privately, the lawyers are welcome to use the source of documentation.
The dateline for objections is 15 working days beginning with the date of the letter was received ( nevertheless send it later, if you had missed the date!).
The information was given that the Vecinos and the APUCSM have objected against the approved plan from the Generalitat to landfill the port Bahia and against the construction of a dry dock by the company “Nautic Center”. The plan violates legal base right and environmental laws and is against the interest of the other owners of property located alongside the canals. Here a combined objection in the interest of all private owners was possible.
The information of a participant that a lot of work had to be done to the canals was answered that the priorities at the moment are to secure the right of the owners and to create a strong representation.
