We are pleased to provide an overview of what the Steering Committee of the Association has produced to date.

 

We did not make public statements in order not to reveal our strategy, which does not mean that we have remained inactive.

 

We met regularly to review progress and give our actions between different language groups.

 

Thanks to advertising placed in the mailboxes, enrolment continues to reach us and we will give you the exact number of our members (about 200)  early next year.

 

The APUCSM consulted a Spanish lawyer, known specialist in the Law of Coasts, to get an opinion on the legal status of Santa Margarita. So we have a very clear view of the situation and received valuable advice to advance the rights of owners. We remain free to choose one or more lawyers if we need it in the future.

 

We were surprised to read in the magazine EMPORDA "of October 27, 2009, a statement by the three Town Councils, Castelló, Roses and San Pere Pescador, saying they were associated with each other and associations Owners of Empuriabrava (EPA) and Rosas (APUCSM), to stand against Madrid.

 

We deny having been formally approached by the City of Roses to defend ourselves, and we  have never asked either, our interests are the opposite of it.

 

Moreover, the "Generalitat de Catalunya" said the magazine EMPORDA "of November 3, 2009,  wants to clean the canals of Santa Margarita, and assign responsibility to the City of Roses, indicating that it would carry out the plans already announced.

 

The City of Roses then said it would speak with citizens to find a dealer who would administer the canals and, later, this dealer had been found, and an agreement with the owners of moorings would be completed.

 

We can only say that the APUCSM, who represents many owners were not consulted.

 

All these announcements obscured the fact that for the moment the Spanish State has not transferred the responsibility of Santa Margarita to the Generalitat of Catalonia.

 

The President of the APUCSM, Federico Macau wrote October 31, 2009 at: www.rosesdigital.com an article entitled "The gardener's dog lives in Rosas. It compares the City Council of the proverbial Rosas (Spain) "gardener's dog" who does not eat but does not let anyone eat either, "meaning that the City Council prevents any solution for both itself and the owners on the canals .

 

He stressed that the City Council has prevented the creation of an "Assembly of Owners" originally planned by the promoter of the urbanization, to legally maintain and manage the channels.

 

It tried with the help of its friends in the Catalan Government to transform Santa Margarita in a large Marina, which could allow the city to collect heavy taxes on the canals and properties ..

 

The City Council has just forgotten that if the Spanish government declared that the river Grao was the sea, nor the Generalitat of Catalonia or the City of Roses would have the responsibility!

 

The authorities of the Spanish Ministry of Coasts, Provincial Office of Girona, announced that almost all the early objections to the delimitation of the maritime-terrestrial public domain, that the Act seeks to impose  in Empuriabrava, were rejected.

 

Martin Fragueiro, the Secretary General in charge, said the "JOURNAL OF GIRONA" of October 30, 2009 that law enforcement in Empuriabrava coast was clear.

 

Santa Margarita was not mentioned and no one has yet received a response to objections, while the demarcation process was started much earlier.

 

Is it because the last objections made by APUCSM were well documented and that the legal status of Santa Margarita is different and more difficult to control by the Ministry of Coasts? Hopefully.

 

The Steering Committee for APUCSM is currently sending letters of invitation to politicians concerned and interested persons of Spanish and European parliaments, to come to see for themselves  Santa Margarita or to get a hearing from them.
